Alcance<\/strong><\/h2>\n\n<p>Las Condiciones Generales de Contrataci\u00f3n (en adelante, \u00abCGC\u00bb) se aplican a todos los pedidos realizados a trav\u00e9s de un sitio web de 7PEAKS SA (en adelante, \u00abnuestros sitios web\u00bb) y a todos los contratos celebrados (en adelante, \u00abpedidos\u00bb).<\/p>\n\n<p>7PEAKS SA se reserva el derecho de modificar las CGC. Se aplicar\u00e1 la versi\u00f3n vigente de las CGC en el momento de realizar el pedido. No se puede modificar unilateralmente para el orden correspondiente.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>2. Ofrece<\/strong><\/h2>\n\n<p>Las ofertas se hacen a clientes que son personas f\u00edsicas o jur\u00eddicas domiciliadas en Suiza o Liechtenstein. Las entregas s\u00f3lo pueden realizarse en direcciones de Suiza o Liechtenstein.<\/p>\n\n<p>Las ofertas son v\u00e1lidas s\u00f3lo mientras aparezcan en la tienda online y\/o hasta agotar existencias. 7PEAKS SA puede modificar sus precios y su gama de productos en cualquier momento. Las im\u00e1genes utilizadas en los medios publicitarios, los folletos, la tienda en l\u00ednea, etc., as\u00ed como toda la informaci\u00f3n sobre los propios productos (listas de ingredientes, informaci\u00f3n sobre alergias, etc.) tienen \u00fanicamente fines ilustrativos y no son vinculantes. S\u00f3lo se aplicar\u00e1 la informaci\u00f3n espec\u00edfica que aparece en el envase del producto.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>3. Precios<\/strong><\/h2>\n\n<p>Los precios se indican en francos suizos e incluyen el impuesto sobre el valor a\u00f1adido (IVA). En su caso, los precios tambi\u00e9n incluyen la tasa de reciclaje anticipado (ARF).<\/p>\n\n<p>Se aplicar\u00e1n los precios indicados en la tienda online en el momento de realizar el pedido.<\/p>\n\n<p>Los pedidos de productos o servicios adicionales con cargo, por ejemplo, entrega, embalaje especial, etc., se indican por separado en la cesta de la compra y en la factura.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>4. Pedir<\/strong><\/h2>\n\n<p>La presentaci\u00f3n de los productos en la tienda online no constituye una propuesta jur\u00eddicamente vinculante, sino un cat\u00e1logo online no vinculante o una invitaci\u00f3n no vinculante a los clientes para pedir un determinado producto en la tienda online. 7PEAKS SA se reserva el derecho de limitar las cantidades de entrega de determinados productos y de no entregar los pedidos de productos excepcionalmente pesados o voluminosos.<\/p>\n\n<p>La realizaci\u00f3n de un pedido constituye una oferta de contrato con 7PEAKS SA.<\/p>\n\n<p>Todos los pedidos est\u00e1n sujetos a un valor m\u00ednimo de compra. Se aplicar\u00e1n los valores m\u00ednimos de compra y los gastos de env\u00edo indicados en la tienda online.<\/p>\n\n<p>Tras la realizaci\u00f3n del pedido, el cliente recibe autom\u00e1ticamente una confirmaci\u00f3n por parte de 7PEAKS SA, que documenta la recepci\u00f3n del pedido. Los clientes pueden cancelar o ampliar su pedido s\u00f3lo hasta que se inicie la tramitaci\u00f3n del mismo en uno de nuestros centros log\u00edsticos. Las adiciones a los pedidos se calculan sobre la base del valor del pedido original. No se tienen en cuenta las ofertas y descuentos especiales aplicables en el momento de la incorporaci\u00f3n.<\/p>\n\n<p>7PEAKS SA puede rechazar un pedido, ya sea en su totalidad o en parte, sin indicar los motivos. En estos casos, 7PEAKS SA informar\u00e1 a sus clientes en consecuencia y reembolsar\u00e1 los pagos ya realizados. No se aceptar\u00e1 ninguna otra reclamaci\u00f3n. En particular, los productos que no se puedan entregar no se entregar\u00e1n en una fecha posterior. Los productos que no est\u00e1n disponibles temporalmente no se pueden pedir por adelantado.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>5. Conclusi\u00f3n de los contratos<\/strong><\/h2>\n\n<p>El contrato se considerar\u00e1 concluido cuando el pedido sea procesado en un centro log\u00edstico de 7PEAKS SA. Los clientes recibir\u00e1n una confirmaci\u00f3n de pedido por correo electr\u00f3nico tan pronto como el pedido correspondiente est\u00e9 listo para su env\u00edo.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>6. Entrega<\/strong><\/h2>\n\n<p><strong>Regi\u00f3n<\/strong><\/p>\n\n<p>La direcci\u00f3n de entrega del cliente debe estar generalmente en Suiza o Liechtenstein.  <\/p>\n\n<p><strong>Plazos de entrega<\/strong><\/p>\n\n<p>General<\/p>\n\n<p>Las franjas horarias de entrega disponibles se muestran en la tienda online y el cliente puede seleccionarlas para la entrega del pedido correspondiente. No es posible fijar una hora de entrega precisa dentro de una franja de entrega determinada. Pueden producirse retrasos y bloquearse determinadas fechas de entrega, especialmente en d\u00edas punta con un volumen de entregas inusualmente alto. Los clientes no tendr\u00e1n derecho a reclamar da\u00f1os y perjuicios ni a hacer ninguna otra reclamaci\u00f3n al respecto.<\/p>\n\n<p>Las entregas no pueden realizarse los domingos ni los d\u00edas festivos nacionales o cantonales.<\/p>\n\n<p>Si el cliente no est\u00e1 presente en la direcci\u00f3n de entrega en el momento de la misma y no ha dado instrucciones especiales de entrega, la entrega se dejar\u00e1 en la puerta del apartamento\/casa o en la recepci\u00f3n\/entrada de la empresa. Dependiendo del plazo de entrega, los pedidos tambi\u00e9n pueden entregarse a un vecino que viva en el mismo edificio si la direcci\u00f3n y el n\u00famero de tel\u00e9fono de este vecino se introdujeron en la cuenta del cliente en \u00abdetalles opcionales\u00bb antes de realizar el pedido. Si el buz\u00f3n del cliente forma parte de un sistema de buzones, el personal de reparto colocar\u00e1 una notificaci\u00f3n de recogida en el buz\u00f3n del cliente. El cliente deber\u00e1 entonces recoger la entrega en la oficina de correos indicada.<\/p>\n\n<p>El cliente ser\u00e1 responsable de los productos entregados, aunque no los haya recibido en persona.  <\/p>\n\n<p><strong>Gastos de env\u00edo<\/strong><\/p>\n\n<p>El coste de la entrega depende del valor total de los productos solicitados (valor m\u00ednimo de la compra excluyendo los gastos de env\u00edo, los dep\u00f3sitos y los cr\u00e9ditos). Se aplican los gastos de env\u00edo indicados en la tienda online y los gastos de env\u00edo. Los gastos de env\u00edo se indican por separado en la cesta de la compra y en la factura.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>7. Garant\u00eda<\/strong><\/h2>\n\n<p>7PEAKS SA garantiza la calidad y la vida \u00fatil de sus productos en las siguientes condiciones Los productos no refrigerados y los productos secos deben almacenarse en un lugar fresco y seco.<\/p>\n\n<p>Para los clientes que puedan presentar pruebas que confirmen el cumplimiento de estas condiciones de almacenamiento, 7PEAKS SA garantiza que los productos solicitados cumplir\u00e1n las normas pertinentes hasta la fecha de consumo preferente correspondiente, aunque no durante m\u00e1s de doce (12) meses a partir de la fecha de entrega. Para los productos que no tienen fecha de consumo preferente se aplica un plazo legal de doce (12) meses a partir de la fecha de entrega.  <\/p>\n\n<p>7PEAKS SA puede cumplir su garant\u00eda mediante la sustituci\u00f3n parcial o total por un producto equivalente, una reducci\u00f3n del precio o la emisi\u00f3n de una nota de cr\u00e9dito hasta el precio de venta aplicable en el momento del pedido.<\/p>\n\n<p>Los clientes no tienen un derecho general de devoluci\u00f3n de los productos sin defectos que se entregan correctamente. Se excluyen expl\u00edcitamente las reclamaciones de garant\u00eda para los productos cuya calidad intr\u00ednseca (por ejemplo, su perfume) no responda a las expectativas del cliente, y para los productos pedidos por error.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>8. Reclamaciones<\/strong><\/h2>\n\n<p>En caso de que los productos entregados presenten da\u00f1os evidentes en su embalaje o contenido, el cliente deber\u00e1 reclamar inmediatamente al personal de entrega y rechazar su aceptaci\u00f3n. Cualquier da\u00f1o relacionado con el transporte tambi\u00e9n debe ser reportado a 7PEAKS SA inmediatamente.<\/p>\n\n<p>Los clientes tambi\u00e9n est\u00e1n obligados a comprobar los productos pedidos inmediatamente despu\u00e9s de la entrega y a almacenarlos correctamente. Cualquier defecto o desviaci\u00f3n de un pedido debe comunicarse al servicio de atenci\u00f3n al cliente del d\u00eda de la entrega, poni\u00e9ndote en contacto con el servicio de atenci\u00f3n al cliente. A partir de entonces, el cliente s\u00f3lo podr\u00e1 reclamar por los vicios ocultos que deber\u00e1 comunicar al servicio de atenci\u00f3n al cliente de 7PEAKS SA inmediatamente despu\u00e9s de descubrirlos. El importe pagado por los clientes por las mercanc\u00edas defectuosas se abona en su cuenta. 7PEAKS SA se reserva el derecho de solicitar pruebas de los defectos.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>9. Pagos<\/strong><\/h2>\n\n<p><strong>Modalidades de pago<\/strong><\/p>\n\n<p>Los pagos deben realizarse en francos suizos (CHF).<\/p>\n\n<p><strong>Pago electr\u00f3nico<\/strong><\/p>\n\n<p>Los clientes pueden pagar con tarjeta de cr\u00e9dito (Visa, Mastercard, American Express, PostFinance Card) o con tarjeta de d\u00e9bito (Postcard). Al pagar con tarjeta de cr\u00e9dito o d\u00e9bito, el importe se carga antes de que el pedido haya sido procesado en el centro log\u00edstico de 7PEAKS SA.<\/p>\n\n<p><strong>Compra a cuenta<\/strong><\/p>\n\n<p>Dado que 7PEAKS SA debe asumir el coste inicial de los pedidos, comprueba la solvencia del cliente antes de la entrega para protegerse de los riesgos de impago. 7PEAKS SA puede rechazar el pago a cuenta sin indicar los motivos. S\u00f3lo los clientes domiciliados o registrados en Suiza o Liechtenstein pueden optar al pago a cuenta.<\/p>\n\n<p>En el caso de los pagos a cuenta cuyos recibos de pago se env\u00edan por correo, las facturas que incluyen los recibos de pago de todos los pedidos de las cuatro (4) semanas anteriores se env\u00edan por separado el d\u00eda 15 de cada mes. Los importes facturados deben liquidarse en su totalidad a finales de mes. Si el cliente opta por el pago mediante un comprobante de pago en l\u00ednea, la factura en l\u00ednea aparece en la cuenta del cliente dentro de los dos (2) d\u00edas h\u00e1biles siguientes a la entrega del pedido. Se debe liquidar en su totalidad a finales de mes.<\/p>\n\n<p>En caso de que un cliente se encuentre en mora y no cumpla con sus obligaciones de pago, ya sea total o parcialmente, todas las cantidades pendientes que el cliente deba a 7PEAKS SA ser\u00e1n pagaderas inmediatamente, independientemente del t\u00edtulo, y 7PEAKS SA podr\u00e1 exigir su liquidaci\u00f3n inmediatamente. En caso de impago, 7PEAKS SA no estar\u00e1 obligada a aceptar nuevos pedidos y tendr\u00e1 derecho a suspender las entregas pendientes.<\/p>\n\n<p>En caso de incumplimiento, 7PEAKS SA tendr\u00e1 derecho a cobrar gastos de reclamaci\u00f3n e intereses de demora. Todos los gastos derivados de la recuperaci\u00f3n y el cobro de los pagos atrasados correr\u00e1n a cargo del cliente. En caso de que los recordatorios no consigan el pago, 7PEAKS SA tendr\u00e1 derecho a encargar a una agencia de cobro de deudas la recuperaci\u00f3n de los importes facturados. Esta agencia de cobro de deudas har\u00e1 valer las reclamaciones de los importes pendientes en su propio nombre y podr\u00e1 cobrar gastos de tramitaci\u00f3n adicionales e intereses de demora desde la fecha de vencimiento.<\/p>\n\n<p><strong>Reembolsos, cr\u00e9ditos y vales<\/strong><\/p>\n\n<p>Si un cliente tiene derecho a un reembolso u otro o a un cr\u00e9dito, el importe correspondiente se acredita en la cuenta del cliente correspondiente y puede utilizarse para compras en 7PEAKS SA.<\/p>\n\n<p>Los vales 7PEAKS SA no se pueden vender ni subastar. S\u00f3lo se puede utilizar un vale por pedido.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>10. Ley aplicable, jurisdicci\u00f3n<\/strong><\/h2>\n\n<p>Todas las relaciones jur\u00eddicas entre 7PEAKS SA y el cliente est\u00e1n sujetas al derecho sustantivo de Suiza, con exclusi\u00f3n de las disposiciones sobre conflictos de leyes y de la Convenci\u00f3n de las Naciones Unidas sobre los contratos de compraventa internacional de mercader\u00edas (Convenci\u00f3n de Viena sobre la compraventa).<\/p>\n\n<p>El lugar de jurisdicci\u00f3n para las personas f\u00edsicas es Lucerna, Suiza, o el domicilio del cliente. El lugar de jurisdicci\u00f3n exclusivo para las personas jur\u00eddicas ser\u00e1 Lucerna, Suiza.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>11. Contacto, servicio de atenci\u00f3n al cliente<\/strong><\/h2>\n\n<p>\u00bfTiene alguna pregunta? Informaremos activamente a las personas cuyos datos de contacto est\u00e9n registrados con nosotros de cualquier cambio importante, siempre que podamos hacerlo sin un esfuerzo desproporcionado.
